Force Majeure in the Era of COVID-19

This will be a presentation regarding how contractual force majeure provisions should be revised to account for COVID-19-related delays and cost increases and address future such events. This presentation will include discussion of the drafting and application of contractual force majeure provisions, as well as best practices for risk management utilizing the construction contracting, product procurement, project management and change order processes, and will include what provisions to include and exclude in contracts and subcontracts; how risk is shifted from general contractors to subcontractors and suppliers; insurance and bonding; payment provisions; as well as dispute resolution and remedies.
